Would any witness to an incident involving uniformed police officers outside Fiction Nightclub in the early hours of Sunday 26 January 2025 please contact me urgently.

 

I act on behalf of a man who was set upon by as many as six police, both male and female; who was capsicum sprayed; who was wrestled to the ground and restrained on the footpath and eventually placed into the rear of a caged police vehicle, before being driven away from the scene.

 

My client has a very short period allowed under the Crimes Act 1900 (ACT) to sue the Commonwealth and individual police involved for damages and compensation under the Human Rights Act 2004 (ACT).

 

CCTV footage has shown that the incident was witnessed by numerous members of the public, some of whom clearly recorded what was happening on mobile telephones.

 

Even if you are not prepared to provide a statement, the provision of a copy of any photographic or video material would be greatly appreciated and likely to be of considerable assistance.

 

THE INCIDENT

 

At about 4.00 am a large, heavy-set man with a completely bald head and well-trimmed dark beard, who was wearing dark trousers, dark shoes and a maroon coloured short-sleeved button up shirt, was talking on the footpath outside Fiction Nightclub with a number of people dressed in black, some of whom were identified by script on their clothing as employees of “Fiction” or as “Security”.

 

That man was then set upon by both a male and a female police officer. The male police officer lifted one leg of the large man in an attempt to tip him over; the female took hold of him as he was driven backwards towards a London plane tree at the intersection of Bunda Street and Garema Place whilst, at the same time, spraying him with Oleoresin Capsicum Spray.

 

Three other police then joined in, grappling with the man before knocking him to the ground where he was restrained for some period of time with at least six or more police standing around, and before he was picked up by police and then placed in a caged police vehicle and driven away from the area.
